EPA issued the Record of Decision for this site in September 2005, outlining the final cleanup plan for the site. The Remedial Design is now underway, pursuant to a Unilateral Administrative Order issued by EPA to Beazer East, Inc., formerly Koppers Co. Inc., in September 2006. The Potentially Responsible Parties (PRPs) performing the cleanup work at the site submitted a Preliminary Remedial Design in December 2008. EPA approved the Preliminary Remedial Design on May 18, 2012. In January 2009, EPA was contacted by the Delaware Nation of Oklahoma, a federally-recognized tribal nation with historic lands including the Koppers Inc. (Newport Plant) Superfund Site. In response, EPA has expanded its consultation with the Delaware Nation and other tribes and interested parties, in an effort to ensure full compliance with the National Historic Preservation Act (NHPA). As of December 2012, EPA is working with the PRPs and the Delaware State Historic Preservation Office to draft a Memorandum of Agreement (MOA) that will document the signatories' plans to comply with the NHPA as is applies to the Site, and worked has resumed on the final design, which is scheduled for completion 2013.
